Welcome to BabyScore

These Terms of Service ("Terms") govern your use of BabyScore's baby care time-tracking application (the "Service"), operated by Anabasis Intelligence ("we," "us," or "our"). By creating an account, accessing, or using BabyScore, you agree to be bound by these Terms.

Please read these Terms carefully. If you don't agree, don't use the Service.

1. Acceptance of Terms

By using BabyScore, you confirm that:

• You are at least 18 years old (or the age of majority in your jurisdiction)
• You have the legal capacity to enter into this agreement
• You will comply with these Terms and all applicable laws
• All information you provide is accurate and truthful

If you're using BabyScore on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration & Security

Creating an Account

• You must provide a valid email address
• You must create a secure password (or use Google OAuth)
• One account per person (no sharing credentials)
• You're responsible for maintaining the confidentiality of your login credentials

Account Security

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, change your password immediately and notify us at support@babyscore.app.

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your account remains inactive for over 2 years
• We discontinue the Service (with 30 days notice)

3. The Service

What BabyScore Does

BabyScore is a time-tracking tool for baby care activities. It allows you to:

• Track who's caring for your baby and for how long
• Tag activities (feeding, changing, playing, etc.)
• Share data with household members
• View stats and leaderboards
• Sync data across devices in real-time

What BabyScore Is NOT

• Not Medical Advice: BabyScore does not provide medical, health, or parenting advice. Consult a pediatrician for health concerns.
• Not a Legal Document: Session data is for personal use only and is not admissible as legal evidence (custody disputes, etc.)
• Not a Guarantee: We strive for accuracy, but the Service is provided "as is" with no warranties (see Section 8)
• Not a Substitute for Communication: BabyScore is a tool—it won't fix relationship problems on its own

4. Free Trial & Subscriptions

7-Day Free Trial

• New users get 7 days of full access for free
• No credit card required for the trial
• After 7 days, you can choose to subscribe to Pro or continue with limited features
• One trial per person (no repeated trials with new accounts)

Pro Tier Subscription

Pricing: $4.69/month for up to 4 caregivers (+ $0.69/month per additional caregiver)

• Billed monthly (auto-renewing)
• Cancel anytime (no cancellation fees)
• Refunds issued at our discretion (see Section 5)
• Prices subject to change with 30 days notice

Payment Processing

Payments are processed securely via Stripe (or similar). By subscribing, you authorize us to charge your payment method. You're responsible for:

• Keeping payment information current
• Paying all applicable taxes
• Resolving declined payments promptly

Cancellation

You can cancel your Pro subscription anytime in Settings. Cancellation takes effect at the end of your current billing period. No prorated refunds for partial months.

5. Refund Policy

• General Rule: All sales are final. Subscriptions are non-refundable.
• Exceptions: We may issue refunds at our sole discretion for:
  • Technical issues preventing use of the Service
  • Duplicate charges due to billing errors
  • Cancellations within 48 hours of initial subscription
• Request Process: Email support@babyscore.app with your account email, order number, and reason for refund request

6. User Conduct & Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to hack, reverse-engineer, or disrupt the Service
• Scrape, data mine, or extract data via automated means (without permission)
• Impersonate others or misrepresent your identity
• Harass, abuse, or harm other users
• Create multiple accounts to abuse trials or promotions
• Share your account credentials with unauthorized users
• Use the Service to spam or send unsolicited messages

Consequences: Violation may result in immediate account suspension or termination without refund.

7. Intellectual Property

Our Content

All content, features, and functionality of BabyScore (including but not limited to text, graphics, logos, icons, images, software, and design) are owned by Anabasis Intelligence and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or exploit any part of the Service without our written permission.

Your Content

You retain ownership of any content you upload (profile pictures, session notes). By uploading content, you grant us a limited license to store, display, and transmit it as necessary to provide the Service.

You represent that you own or have permission to upload any content you provide.

Trademark

"BabyScore," the BabyScore logo, and "Track it. Prove it. Win." are trademarks of Anabasis Intelligence. You may not use these marks without permission.

8. Disclaimers & Warranties

We Do Not Guarantee:

• The Service will be uninterrupted, error-free, or secure
• Data will always be accurate or complete
• Defects will be corrected immediately
• The Service will meet your specific needs
• Results from using the Service (improved relationships, fair splits, etc.)

No Medical or Legal Advice

BabyScore is not a substitute for professional advice. We are not liable for any decisions you make based on data from the Service. Always consult qualified professionals (doctors, lawyers, therapists) for medical, legal, or relationship matters.

Use at Your Own Risk

You use BabyScore at your own risk. We are not responsible for any harm resulting from your use or inability to use the Service.

9. Limitation of Liability

Our total liability to you for any claims arising from the Service is limited to the amount you paid us in the 12 months prior to the claim (or $100, whichever is greater).

Examples of What We're Not Liable For:

• Arguments or relationship problems arising from using the Service
• Data loss due to your device failure, internet outage, or user error
• Inaccurate session data caused by forgotten clock-ins or user mistakes
• Third-party services (Supabase, payment processors) beyond our control
• Losses from unauthorized access to your account (if you didn't secure it properly)

10. Indemnification

You agree to defend, indemnify, and hold harmless Anabasis Intelligence, its affiliates, and team members from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any laws or rights of third parties
• Content you upload to the Service

Translation: If you do something wrong and someone sues us because of it, you're responsible for the costs.

11. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data.

By using BabyScore, you consent to our data practices as described in the Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. When we do:

• We'll update the "Last Updated" date at the top
• We'll notify you via email or in-app notification for material changes
• Changes take effect 7 days after notification (unless you object by canceling your account)
• Continued use after changes means you accept the updated Terms

If you don't agree with the changes, you must stop using the Service and cancel your account.

13. Termination

Your Right to Terminate

You can delete your account at any time in Settings. Upon deletion:

• Your access to the Service ends immediately
• Your data enters a 30-day grace period, then is permanently deleted
• No refunds for unused Pro subscription time

Our Right to Terminate

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• We're required to do so by law
• We discontinue the Service (with 30 days notice to Pro users)

Effects of Termination

Upon termination (by you or us):

• Your license to use the Service ends
• All provisions that should survive (indemnification, limitations of liability, dispute resolution) remain in effect
• We may retain anonymized analytics data for product improvement

14. Dispute Resolution & Governing Law

Informal Resolution First

If you have a dispute with us, please contact us at support@babyscore.app and give us 30 days to resolve it informally before pursuing legal action.

Governing Law

These Terms are governed by the laws of [Your State], United States, without regard to conflict of law principles.

Arbitration (Optional - Consult Legal Counsel)

[If you want to include arbitration clauses, consult a lawyer. For now, keeping it simple:]

Any disputes not resolved informally will be handled in the courts of [Your County/State]. You and we both waive the right to a jury trial.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action, consolidated action, or representative action.

15. Miscellaneous

Entire Agreement

These Terms (plus our Privacy Policy) constitute the entire agreement between you and Anabasis Intelligence regarding the Service.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any right or provision doesn't waive our right to enforce it later.

Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to another entity (e.g., if we're acquired).

Force Majeure

We're not liable for delays or failures caused by events beyond our reasonable control (natural disasters, pandemics, internet outages, government actions, etc.).
